This Privacy Policy outlines how Midland Chiro Clinic Pty Ltd, trading as Midland Chiropractic Care, collects, holds, uses and discloses personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

As a healthcare provider, Midland Chiropractic Care collects and manages health information in order to provide safe, effective and appropriate patient care. Health information is considered sensitive information under Australian privacy legislation and is afforded a higher level of protection.

By attending the clinic, engaging with our services, using our website, or communicating with our staff, individuals acknowledge that their personal information may be collected, used and disclosed in accordance with this Privacy Policy.

INFORMATION WE COLLECT

Midland Chiropractic Care collects personal information that is reasonably necessary for the provision of healthcare services and for the operation of the clinic.

The personal information collected may include identifying information such as a patient’s name, residential address, date of birth, telephone number, email address and emergency contact details. Where patients are under the age of eighteen, the clinic may also collect contact information relating to parents or legal guardians.

In the course of providing chiropractic care, Midland Chiropractic Care collects health information relevant to a patient’s treatment. This may include medical history, presenting symptoms, clinical examination findings, diagnoses, treatment records, imaging or diagnostic reports, referrals and correspondence with other healthcare providers. Information relating to insurance claims, compensation schemes or other legal matters associated with treatment may also be collected where relevant.

Administrative and billing information may also be collected in order to manage appointments, process payments and maintain accurate patient records. This may include appointment history, billing records, Medicare or health fund information, and insurance details where applicable.

HOW PERSONAL INFORMATION IS COLLECTED

Personal information is primarily collected directly from patients. This typically occurs when patients complete intake forms, make appointments, attend consultations, communicate with clinic staff, or correspond with the clinic via telephone, email or online forms.

Information may also be collected through online booking systems and through interactions with the clinic’s website. In some circumstances, Midland Chiropractic Care may receive information from third parties involved in a patient’s care or legal matter. These third parties may include referring healthcare practitioners, insurers, compensation schemes, legal representatives, or family members where appropriate.

The clinic takes reasonable steps to ensure that personal information collected is accurate, complete and relevant to the purpose for which it is collected.

ONLINE BOOKING AND THIRD PARTY PLATFORMS

Midland Chiropractic Care provides online appointment booking through third-party platforms including HealthEngine and PracSuite. When patients make appointments using these services, certain personal information may be collected and processed by the platform in order to facilitate the booking. These services operate under their own privacy policies and terms of use. Patients are encouraged to review those policies when using third-party platforms.

PURPOSE OF COLLECTING PERSONAL INFORMATION

Personal information is collected primarily for the purpose of providing healthcare services. This includes assessing and diagnosing health conditions, delivering treatment, maintaining accurate clinical records and communicating with patients regarding their care.

Information may also be used to manage appointments, issue reminders, process payments and comply with legal and regulatory requirements associated with operating a healthcare practice.

Where appropriate, Midland Chiropractic Care may also use personal information to communicate with patients about clinic services, health updates or reminders to schedule appointments. Patients may opt out of receiving marketing or promotional communications at any time.

DISCLOSURE OF PERSONAL INFORMATION

In certain circumstances, Midland Chiropractic Care may disclose personal information to third parties where it is necessary for the provision of healthcare services or where disclosure is required or authorised by law.

Such disclosures may occur between Midland Chiropractic Care and other healthcare practitioners involved in a patient’s care, including general practitioners, specialists and diagnostic imaging providers. Personal information may also be disclosed to health funds, Medicare, insurance companies, compensation schemes such as WorkCover WA, or legal representatives where relevant to a patient’s treatment or claim.

Where possible, the clinic will seek a patient’s consent before disclosing personal information to third parties. In some circumstances, disclosure may occur without consent where it is required by law or necessary to prevent serious risk to health or safety.

STORAGE AND SECURITY OF PERSONAL INFORMATION

Midland Chiropractic Care takes reasonable steps to protect personal information from misuse, loss, unauthorised access, modification or disclosure.

Patient records are maintained using secure electronic practice management software, including the PracSuite system, as well as clinic computer systems and secure email services through Google Workspace. Access to patient information is restricted to authorised staff who require the information in order to perform their duties.

Appropriate administrative and technical safeguards are implemented to maintain the confidentiality and security of patient information.

RETENTION OF HEALTH RECORDS

Midland Chiropractic Care retains patient health records in accordance with applicable legal, regulatory and professional obligations.

Health records are generally retained for a minimum period consistent with accepted healthcare record retention standards. In most circumstances, patient records are retained for at least seven (7) years from the date of the patient’s last consultation.

Where treatment is provided to a patient who is under the age of eighteen at the time of consultation, records may be retained until the patient reaches the age of twenty-five (25) in accordance with common healthcare record retention guidelines.

Records may be retained for longer periods where it is reasonably necessary for clinical care, legal proceedings, insurance matters, regulatory compliance, or other legitimate business purposes.

USE OF ARTIFICIAL INTELLIGENCE AND DIGITAL TOOLS

Midland Chiropractic Care may utilise digital technologies, including artificial intelligence (AI) and automated software tools, to assist with administrative functions and clinical documentation processes. Where AI systems are used to assist with administrative or documentation processes, patient information may be processed electronically for these purposes.

These tools may be used to support activities such as drafting clinical notes, generating correspondence, preparing reports, summarising information, or assisting with administrative tasks within the clinic. AI tools are used only as assistive technologies and do not replace professional clinical judgement. All clinical decisions and patient care remain the responsibility of the treating practitioner.

Where AI tools are used in connection with patient information, Midland Chiropractic Care takes reasonable steps to ensure that appropriate safeguards are in place to protect personal and health information. Any use of such technologies is conducted in a manner consistent with the Privacy Act 1988 (Cth) and the Australian Privacy Principles, particularly with respect to maintaining confidentiality and protecting sensitive health information.

Midland Chiropractic Care aims to ensure that any third-party software or digital tools used in the clinic maintain appropriate privacy and security standards. Where possible, information shared with such systems is limited to what is reasonably necessary for the intended purpose.

The clinic regularly reviews its use of digital technologies to ensure that privacy risks are appropriately managed and that patient information continues to be handled in a secure and responsible manner.
